Trademark and Copyright Registration with IPO Pakistan

How to register and enforce trademarks and copyright in Pakistan through IPO Pakistan — clearance searches, Nice classification, examination and opposition, renewal, IP ownership in contracts, and enforcement options.

Three registers, three different rights

The single most expensive misunderstanding in Pakistani brand protection is the belief that registering a company covers the brand. It does not. Three separate systems are in play:

  • A company name on the SECP register identifies a legal entity. It says nothing about who may use that word commercially.
  • A domain name is a contractual allocation from a registrar, granted on a first-come basis with no examination of rights at all.
  • A trademark registered with the Intellectual Property Organization of Pakistan is the actual right to stop others using a confusingly similar sign for similar goods or services.

Businesses discover the difference when they receive a cease-and-desist from someone who registered the mark while they were building the goodwill — and find that four years of trading gives them a passing-off argument, not a registration.

Search before you print anything

A clearance search at IPO before you commit to a name is the cheapest step in the entire process and the one most often skipped. What you are looking for is not only identical marks but deceptively similar ones in the same or related classes — similarity is assessed by overall impression, including phonetic similarity, not by letter-by-letter comparison.

Sequence matters. Search, then reserve the company name, then register the domain, then file the trademark. Doing it in the reverse order is how businesses end up with signage, packaging and a social following built on a name they cannot keep.

Classes: protection is per class, not per brand

Trademarks are registered under the Nice classification, which divides goods and services into classes. Registration protects the mark in the classes you file in and, broadly, against confusingly similar use in related fields — but not across all commerce.

A restaurant registering in the services class has not protected the same name on bottled sauces. A software company registering its product name has not protected it on training services. Map the classes to where the business realistically goes in the next few years and file accordingly, accepting that each class carries its own fee.

Filing in classes you will never trade in is not a solution either — a registration unsupported by genuine use is vulnerable to cancellation for non-use after the statutory period.

The registration process

  1. Filing with IPO Pakistan under the Trade Marks Ordinance 2001, specifying the mark, the applicant, and the goods or services in the correct class.
  2. Examination for absolute grounds (is the mark descriptive, generic, deceptive?) and relative grounds (does it conflict with an earlier mark?). Objections are communicated and can be answered.
  3. Publication in the Trade Marks Journal.
  4. Opposition window, during which third parties may oppose. Oppositions are contested proceedings with evidence and hearings.
  5. Registration and issue of the certificate.

Protection runs for ten years from the application date and is renewable for further ten-year terms indefinitely on payment of renewal fees. Diary the renewal — lapsed marks are re-registered by competitors with some regularity.

Copyright: automatic, but register anyway

Copyright subsists automatically when an original work is created in a fixed form — text, software, designs, film, music, photographs. Registration with the Copyright Office at IPO Pakistan is voluntary and does not create the right.

It is nonetheless worth doing, because litigation and platform takedowns turn on evidence rather than on principle. A registration certificate is clean documentary proof of what the work was and when you claimed it — which is precisely the point that is contested when an infringer claims independent creation or prior authorship.

Who owns what your contractors make

Work created by an employee in the course of employment generally vests in the employer. The position for independent contractors is different and routinely misunderstood: absent a written assignment, the contractor may retain rights in what they created, even though you paid for it.

This affects almost every modern business — logos from a freelance designer, a website from an agency, software from a contract developer, photography and video from a production company. An invoice is not an assignment. Take an express written assignment of intellectual property in the engagement document, before work starts.

Check this before a funding round or a sale. IP ownership gaps in contractor agreements are a standard due-diligence finding, and they are far more expensive to fix retrospectively — the contractor knows exactly how much leverage they have.

Enforcement options

The usual sequence is a cease-and-desist notice, then proceedings. Where the mark is registered, the claim is infringement; where it is unregistered but you have established goodwill, the claim is passing off, which requires proof of goodwill, misrepresentation and damage. Both are normally accompanied by an application for a temporary injunction where the harm is ongoing.

Parallel routes are often faster and cheaper than litigation:

  • Opposition, rectification or cancellation proceedings at IPO.
  • Complaints through the intellectual property mechanisms of online marketplaces and social platforms.
  • Customs recordal to intercept counterfeit imports at the border.

A Pakistani registration stops at the border

Trademark rights are territorial. A Pakistani registration gives no protection in the UAE, the UK, the US or anywhere else. Protection abroad requires filing there, either directly through the national office or, where available, through the international filing systems administered by WIPO.

Exporters should file in their key markets early. Bad-faith registration of a foreign brand by a local distributor is a recurring and expensive problem, and the remedy — cancellation proceedings in a foreign forum — costs many times what a timely application would have.

ٹریڈ مارک نائس کلاسیفکیشن کے تحت رجسٹر ہوتا ہے اور تحفظ ہر کلاس کے لیے الگ ہوتا ہے۔ ریستوران جس نے خدمات کی کلاس میں نام رجسٹر کرایا ہو، اُس نے بوتل بند ساس پر وہی نام محفوظ نہیں کیا۔ آئندہ چند برسوں کے کاروبار کے مطابق کلاسز کا انتخاب کریں، مگر ایسی کلاسز میں درخواست نہ دیں جہاں آپ کبھی کام نہیں کریں گے، کیونکہ استعمال کے بغیر رجسٹریشن منسوخی کے خطرے میں رہتی ہے۔

عمل کے مراحل یہ ہیں: ٹریڈ مارکس آرڈیننس 2001 کے تحت درخواست، جانچ، ٹریڈ مارکس جرنل میں اشاعت، فریقِ ثالث کے لیے اعتراض کی مدت، اور رجسٹریشن۔ تحفظ درخواست کی تاریخ سے دس سال کے لیے ہوتا ہے اور فیس کے ساتھ لامحدود مدت تک تجدید ہو سکتا ہے۔ تجدید کی تاریخ ضرور یاد رکھیں، کیونکہ ختم شدہ نشانات حریف اکثر خود رجسٹر کرا لیتے ہیں۔
