The federal–provincial split, and why it catches people out
Pharmaceutical regulation in Pakistan runs on two tracks that people routinely assume are one. The Drug Regulatory Authority of Pakistan, established under the DRAP Act 2012, is the federal regulator: it governs manufacture, import, export, registration of therapeutic goods and pricing. Provincial health departments run the licensing and inspection of premises where drugs are sold — retail and wholesale drug sale licences — and their inspectors are the people who will actually walk into your shop or warehouse.
The practical consequence is that a pharmaceutical business almost always needs authorisation on both tracks, and a valid licence on one does not cure the absence of the other. A distributor with a DRAP-registered product and no provincial sale licence is unlicensed for the activity that matters.
Which authorisation does your business actually need?

Classify the product before you plan anything else. Whether an item is a drug, a medical device, a health supplement or an alternative medicine determines which regime applies, which dossier you build, and how long approval takes. Businesses lose entire quarters by preparing the wrong submission.
Product registration: the dossier decides the timeline
Registration is granted product by product, not to the company in general. The dossier is expected to cover:
- Composition and formulation, with the function of each excipient.
- Specifications for the active ingredient and the finished product, and validated analytical methods.
- Stability data supporting the proposed shelf life and storage conditions.
- The manufacturing site, process and controls, with GMP status evidence.
- Labelling, packaging and the proposed pack insert.
- Bioequivalence or clinical data where the category requires it.
The application is evaluated and placed before the registration board. Pricing approval is a distinct step with its own criteria — a registered product you cannot lawfully price is not a marketable product, so plan for both.
Applicants consistently underestimate how much of the timeline is theirs rather than the regulator’s. A dossier with incomplete stability data or an unvalidated analytical method generates a query, and the clock then runs on your response, not on the evaluation.
Premises and the inspection you will face
For a sale licence, the premises inspection is where most applications succeed or fail. Prepare for the inspector to check:
- Floor area, layout and separation of storage from dispensing.
- Refrigeration with a working temperature log — not just a fridge, but evidence of monitoring.
- The qualified person’s presence, qualification documents and registration.
- Purchase invoices traceable to licensed suppliers, and sale records.
- Segregation and documented disposal of expired stock.
- Absence of unregistered, misbranded or smuggled products anywhere on the premises.
One unregistered pack on the shelf can convert a routine inspection into a seizure and a prosecution, regardless of how compliant the rest of the operation is. Audit your own stock before you invite an inspection.
Renewal: the deadline that quietly costs the most
Licences run for a fixed term and renewal applications are due before expiry. Letting a licence lapse generally means applying afresh, which can mean re-satisfying capital, premises or deposit requirements that a renewal would have carried over — and, in the interim, operating unlicensed.
Renewal typically requires evidence of continued compliance: tax filings, a current premises inspection, staff qualifications, and clearance of any dues. Diary the renewal window at ninety days before expiry, not at expiry.
If a show-cause, suspension or seizure happens
Regulators must generally issue a show-cause notice and give a hearing before an adverse order. The governing statute usually provides an internal appeal, and beyond that judicial review through a writ petition in the High Court under Article 199 of the Constitution.
The practical sequence when a notice arrives:
- Preserve the record. Photograph the premises, secure the stock registers and purchase invoices, and obtain a copy of any seizure memo signed at the time.
- Read the allegation precisely. Reply to the specific charge — an unregistered product, an absent qualified person, a storage failure — not with a general assertion of good conduct.
- Reply within time. A late reply forfeits the strongest procedural argument you have.
- Seek interim protection where suspension would destroy the business before the appeal is heard. Courts understand that a remedy delivered after insolvency is no remedy.
Structure the business for the licence, not after it
Two structural points are worth settling before incorporation. First, the objects clause in your memorandum must actually authorise manufacture, import or sale of drugs — a regulator that reads a generic trading clause will ask you to amend it. Second, decide who holds the licence: a licence issued to a company is a company asset, whereas one issued to an individual proprietor does not transfer with a sale of the business and dies with the proprietor.
Businesses that intend to be sold, franchised or brought under investment should hold authorisations in a company from the start. Restructuring afterwards can mean fresh applications rather than transfers.

کسی بھی منصوبہ بندی سے پہلے پروڈکٹ کی درجہ بندی طے کریں — آیا وہ دوا ہے، طبی آلہ، غذائی ضمیمہ یا متبادل طریقۂ علاج کی مصنوعات۔ یہی طے کرتا ہے کہ کون سا ضابطہ لاگو ہوگا، کون سا ڈوزیئر بنے گا اور منظوری میں کتنا وقت لگے گا۔ غلط درخواست تیار کرنے پر کاروبار پورے پورے مہینے ضائع کر دیتے ہیں۔
رجسٹریشن ہر پروڈکٹ کے لیے الگ ہوتی ہے، کمپنی کے لیے مجموعی نہیں۔ ڈوزیئر میں فارمولیشن، خام مال اور تیار پروڈکٹ کی تفصیلات اور تصدیق شدہ تجزیاتی طریقے، استحکام کا ڈیٹا، تیاری کا مقام اور جی ایم پی حیثیت، لیبلنگ و پیکجنگ، اور ضرورت کے مطابق بائیو ایکویویلینس یا کلینیکل ڈیٹا شامل ہوتا ہے۔ قیمت کی منظوری ایک الگ مرحلہ ہے۔

تجدید کی درخواست میعاد ختم ہونے سے پہلے دینا ہوتی ہے۔ لائسنس ختم ہو جائے تو عموماً نئے سرے سے درخواست دینا پڑتی ہے، اور اُن سرمائے یا ڈپازٹ کی شرائط دوبارہ پوری کرنا پڑتی ہیں جو تجدید میں برقرار رہتیں — اور اس دوران کاروبار بلا لائسنس شمار ہوتا ہے۔ تجدید کا وقت میعاد ختم ہونے سے نوے دن پہلے مقرر کریں۔
وجہ بتاؤ نوٹس یا ضبطی کی صورت میں ترتیب یہ ہے: ریکارڈ محفوظ کریں اور ضبطی میمو کی نقل لیں؛ الزام کو بغور پڑھ کر اُسی مخصوص الزام کا جواب دیں، عمومی صفائی نہ پیش کریں؛ مقررہ وقت میں جواب دیں؛ اور جہاں معطلی اپیل کی سماعت سے پہلے کاروبار تباہ کر دے، وہاں آئین کی دفعہ 199 کے تحت عبوری تحفظ حاصل کریں۔
آخر میں دو ڈھانچہ جاتی نکات: میمورنڈم کی مقاصد کی شق میں ادویات کی تیاری، درآمد یا فروخت کی صراحت ہونی چاہیے؛ اور یہ طے کریں کہ لائسنس کس کے نام ہوگا۔ کمپنی کے نام جاری لائسنس کمپنی کا اثاثہ ہوتا ہے، جبکہ انفرادی پروپرائٹر کے نام جاری لائسنس کاروبار کی فروخت کے ساتھ منتقل نہیں ہوتا۔
