Professional Licensing in Pakistan: PEC, PMDC and the Bar Councils

How professional registration works for engineers, doctors and advocates in Pakistan — PEC registration and firm licensing, PMDC registration and foreign qualification routes, bar council enrolment, CPD, renewal and disciplinary process.

What all professional regulators have in common

Engineering, medicine and law are regulated by statutory bodies rather than by ordinary business licensing. Despite operating under different statutes, they share the same architecture, and understanding it saves a great deal of confusion:

  • An individual register. Only registered persons may use the protected title and do the reserved work.
  • An entity licence, in some cases. The firm or practice is licensed separately from the individuals in it.
  • A recognition pathway for foreign qualifications, usually involving verification, equivalence and often an examination.
  • Continuing obligations — renewal, fees, and in several cases continuing professional development.
  • A disciplinary jurisdiction with power to reprimand, suspend or remove from the register, subject to due process and judicial review.

Registration and permission to trade are different things. A registered engineer still needs a company or firm registration to contract, and the firm still needs its own licence category to bid for work. People routinely obtain one and assume it covers the other.

Engineers: the Pakistan Engineering Council

PEC maintains the register of engineers and licenses engineering firms. Two distinct registrations matter:

Individual registration follows an accredited engineering degree and is the basis for using the professional title and taking responsibility for engineering work. Progression to higher categories of registration is tied to documented experience and, for renewal, to continuing professional development points earned through recognised activities.

Firm licensing is separate and categorised — the category determines the value and type of projects the firm may undertake. It is assessed on the firm’s registered engineers, their experience, equipment and financial standing. This is the registration that public sector tenders check, and a firm operating above its licensed category will be disqualified at evaluation regardless of technical capability.

Practical points: keep CPD current rather than accumulating it in the month before renewal; ensure the engineers named in a firm licence application are genuinely employed by the firm; and update the register when key personnel leave, because a licence resting on an engineer who has moved on is a problem waiting to surface at an audit.

Doctors and dentists: the medical regulator

Medical and dental practitioners register with the national medical and dental regulator. Registration follows a recognised qualification and the prescribed house job or internship, and is required before independent practice.

Two areas cause the most difficulty:

Foreign qualifications. Graduates of foreign institutions go through a recognition pathway — verification of the qualification with the awarding institution, an equivalence or recognition assessment, and in many cases a licensing examination. Start this process before returning to Pakistan, not after; verification correspondence with a foreign university takes months and cannot be accelerated by follow-up in Islamabad.

Practice premises. Individual registration authorises the person; it does not authorise the clinic, hospital or diagnostic facility. Health establishments are separately regulated by the provincial healthcare commissions, with their own registration, minimum service delivery standards and inspection regimes. A registered doctor operating an unregistered facility is exposed on the facility side.

Advocates: enrolment with the bar councils

Legal practice is regulated by the provincial bar councils and the Pakistan Bar Council. The progression is sequential: enrolment with a provincial bar council after the law degree and the prescribed requirements, which permits practice in the subordinate courts; then, after the prescribed period of practice and satisfying the applicable conditions, a licence to appear before the High Court; and subsequently, after the further prescribed period and examination, enrolment with the Pakistan Bar Council for the Supreme Court.

Two consequences follow for clients rather than lawyers. First, a lawyer’s licence determines which forum they can appear in — an advocate not licensed for the High Court cannot argue your appeal there and will need to instruct someone who is. Second, enrolment is verifiable: bar councils maintain rolls, and if you are engaging counsel you have not worked with before, the enrolment number is worth checking.

Getting foreign credentials recognised

Whatever the profession, the sequence for foreign qualifications is broadly the same, and doing it out of order costs months:

  1. Obtain the final award and transcripts from the awarding institution, in the form the Pakistani regulator will accept.
  2. Have the qualification verified — regulators generally verify directly with the institution rather than relying on your copies.
  3. Obtain equivalence or recognition from the relevant authority; for academic equivalence this commonly involves the Higher Education Commission.
  4. Complete attestation of documents as required, including Ministry of Foreign Affairs attestation or an apostille where the destination accepts it.
  5. Sit any licensing or equivalence examination the regulator requires.
  6. Apply for registration with the complete file.

Complaints, suspension and appeal

Each regulator has a disciplinary jurisdiction over its registrants, exercised through a committee or council with power to reprimand, fine, suspend or remove from the register. These are quasi-judicial proceedings and the procedural protections are real: notice of the specific allegation, disclosure of the material relied on, an opportunity to be heard, and a reasoned decision.

If you receive a notice, three things matter more than the strength of your defence. Reply within time. Reply to the specific allegation with documents rather than character references. And treat the first written response as the foundation of any later appeal, because a decision made against you on an incomplete record is much harder to displace later.

Where an internal appeal is exhausted or the process itself was defective, a writ petition under Article 199 of the Constitution is the route to the High Court. Courts are generally reluctant to substitute their own view on professional merits, but they will intervene where the procedure was unfair or the decision was made without jurisdiction.

Renewal is the obligation people forget

Registration lapses. Renewal is generally due before expiry and typically requires fees, evidence of continuing professional development where applicable, and confirmation of current practice details.

A lapsed registration can mean that work done in the interim was done by an unregistered person — with consequences for the validity of certifications signed, for insurance cover, and for any tender in which current registration was a condition. Diary renewal at ninety days, and keep the CPD record contemporaneously.

عملی مشورے: سی پی ڈی پوائنٹس تجدید سے ایک ماہ پہلے جمع کرنے کے بجائے مسلسل برقرار رکھیں؛ فرم کے لائسنس میں نامزد انجینئرز واقعی فرم کے ملازم ہوں؛ اور اہم عملے کے جانے پر ریکارڈ فوراً اپ ڈیٹ کریں۔

غیر ملکی اسناد کی تسلیم کی ترتیب یہ ہے: جامعہ سے سند اور ٹرانسکرپٹ، پھر ریگولیٹر کی جانب سے براہِ راست تصدیق، پھر متعلقہ ادارے سے مساوات — تعلیمی مساوات کے لیے عموماً ایچ ای سی — پھر وزارتِ خارجہ کی تصدیق یا اپوسٹیل، پھر مطلوبہ امتحان، اور آخر میں مکمل فائل کے ساتھ رجسٹریشن کی درخواست۔ ترتیب بدلنے سے مہینے ضائع ہوتے ہیں۔

تادیبی نوٹس کی صورت میں تین باتیں دفاع کی مضبوطی سے زیادہ اہم ہیں: مقررہ وقت میں جواب دیں؛ کردار کی سفارشوں کے بجائے مخصوص الزام کا دستاویزی جواب دیں؛ اور پہلے تحریری جواب کو آئندہ اپیل کی بنیاد سمجھیں۔ اندرونی اپیل ختم ہو جانے یا طریقِ کار میں خرابی کی صورت میں آئین کی دفعہ 199 کے تحت ہائی کورٹ میں رٹ کا راستہ موجود ہے۔ اور تجدید نہ بھولیں — ختم شدہ رجسٹریشن کے دوران کیا گیا کام غیر رجسٹرڈ شخص کا کیا ہوا شمار ہو سکتا ہے۔
